EXPRESSION OF INTEREST (EOI)

PROVISION OF MARKING AND MONITORING OF
PETROLEUM PRODUCTS
The Energy Regulatory Commission (ERC) is established under the Energy Act, No. 12 of 2006 as a single sector  regulatory agency with the responsibility for economic and technical regulation of electric power, renewable energy and downstream petroleum energy sub-sectors including tariff setting and review, licensing, enforcement, dispute settlement and approval of power purchase and network service contracts.
ERC requires the services of a reputable firm (or consortia of firms) to mark and monitor petroleum fuels in the country with a view of eliminating diversion of export petroleum products and/ or adulteration of petroleum motor fuels with domestic kerosene. The scope of the services required is:
1. Marking of super petrol, diesel and kerosene destined for export markets at designated loading depots in Kenya,
2. Marking of super petrol, diesel and kerosene destined for duty free consumers at designated loading depots in Kenya,
3. Marking of kerosene (and any other designated adulterant) meant for consumption within Kenyan borders with a separate petroleum marker,
4. Monitoring of petroleum fuels at retail dispensing sites and any consumer sites to check for possible diversion of export products or adulteration of petroleum motor fuels,
5. Monitoring of petroleum fuels conveyed in petroleum tankers to check for possible diversion of export products or adulteration of petroleum motor fuels, and
6.  Provision and management of supply for retailer self-test kits for the proposed marker technology.
The contract is envisaged to be for a maximum duration of three (3) years subject to satisfactory performance.
Interested and eligible firms shall provide information demonstrating that they have the necessary qualifications, capability, experience, resources, equipment and facilities to undertake this project. Such information may include brochures, description of similar assignments, and experience in similar conditions as well as availability of appropriate skills among staff.
Completed EOI proposals submitted in four (4) printed copies (1 original and 3 copies) and one soft copy in “pdf” format in a CD-ROM which should be enclosed in plain sealed envelopes, marked “ERC/PROC/4/3/EXPRESSION OF INTEREST (EOI)14-15/020 PROVISION OF MARKING AND MONITORING OF PETROLEUM PRODUCTS” and addressed

The EoI submissions shall be deposited in the Tender Box situated on 1st Floor, Eagle Africa Centre, Longonot Road, Upperhill, Nairobi so as to reach the above address not later than Tuesday, 19th August, 2014 at 2.30 p.m. The EoI submissions will be opened immediately thereafter in the presence of the tenderers’ representatives who choose to attend the opening at the Hearing Room situated at 1st Floor of ERC offices.

The firms deemed qualified will upon completion of an objective evaluation of their submitted EoI proposals receive the final Request for Proposal (RFP) document.
